Terms of Service
Effective Date: April 7, 2026
Article 1 (Purpose)
These Terms govern the conditions, procedures, rights, obligations, and responsibilities between UpFinance ("the Company") and users regarding the use of cryptocurrency card payment services and related services ("Services").
Article 2 (Definitions)
- "Services": All services provided by the Company, including cryptocurrency deposits, card issuance, payments, and settlement
- "User": A member who has entered into a service agreement with the Company under these Terms
- "Cryptocurrency": Digital assets supported by the Company, such as USDT
- "Card": Virtual or physical cards issued by the Company (Visa network-based)
- "Wallet": Electronic means for managing cryptocurrency deposits and balances
Article 3 (Effectiveness and Modification)
- These Terms take effect when posted on the service or otherwise communicated to users.
- The Company may modify these Terms within the bounds of applicable law, with changes announced at least 7 days before the effective date.
- Users who disagree with modified Terms may discontinue use and withdraw from the service.
Article 4 (Registration and Withdrawal)
- Users apply for registration following the Company's prescribed procedures, and a service agreement is established upon the Company's approval.
- The Company may reject registration if KYC and AML procedures are not completed.
- Users may request withdrawal at any time through service settings or customer support, and the Company will process it without delay within legal limits.
- Upon withdrawal, remaining cryptocurrency will be transferred to an external wallet designated by the user.
Article 5 (Services Provided)
- Cryptocurrency deposits: Deposit supported cryptocurrencies such as USDT into user wallets
- Card issuance: Virtual and physical card issuance (accepted at Visa merchants)
- Payments and withdrawals: Payments at Visa merchants worldwide and ATM withdrawals
- Settlement: T+0 real-time settlement
- Others: Additional services provided by the Company
Article 6 (Investment Risk Disclosure)
Important: Cryptocurrency Risk Disclosure
- Cryptocurrencies are not legal tender and are not guaranteed by any government or central bank.
- Cryptocurrency prices are highly volatile, and loss of principal may occur.
- The Company is not responsible for losses due to cryptocurrency value fluctuations.
- Users must fully understand the characteristics and risks of cryptocurrency before using the service.
- Cryptocurrency regulations may vary by country, and users are responsible for complying with their local laws.
- The Company's services do not constitute investment advice, and users are solely responsible for their investment decisions.
Article 7 (User Obligations)
- Users must provide accurate information and update it immediately when changes occur.
- Users may not use others' information or use the service for fraudulent purposes.
- Users must comply with applicable laws, these Terms, and the Company's notices.
- The service may not be used for illegal activities such as money laundering or terrorist financing.
Article 8 (Company Obligations)
- The Company will do its best to provide stable services.
- The Company will protect users' personal information in accordance with applicable laws.
- The Company will strive to promptly restore services in case of disruptions.
Article 9 (Disclaimers)
- The Company is not liable for service interruptions due to force majeure such as natural disasters, war, power outages, or hacking.
- The Company is not liable for service disruptions caused by users' own actions.
- The Company has no obligation to intervene in disputes between users or between users and third parties.
- The Company is not liable for damages caused by external factors such as blockchain network delays or fee fluctuations.
- The Company is exempt from liability for service limitations or suspensions due to regulatory changes, provided prior notice is given.
Article 10 (Dispute Resolution)
- Disputes related to these Terms shall be governed by the laws of the Republic of Korea.
- The court with jurisdiction over the Company's headquarters shall be the exclusive court of jurisdiction for service-related disputes.
Supplementary Provisions
These Terms shall take effect from April 7, 2026.
